ACTA Battle Nears Climax in Europe

<img src="http://www.piratepartycyprus.com/news/data/upimages/fuck-ACTA.jpg" border="0" alt="fuck ACTA title="fuck ACTA" />The European Parliament’s international trade committee has rejected a proposal by David Martin, an MEP who is drafting the Parliament’s position on ACTA. Martin wanted to ask the European Court of Justice for its opinion on the controversial anti-piracy treaty, but the committee decided yesterday that wasn’t needed and will now vote in June on whether to approve ACTA. Opponents of the treaty see the development as a victory.

In a February announcement, EU trade chief Karel De Gucht said that following discussion with fellow Commissioners, the Anti-Counterfeiting Trade Agreement (ACTA) would be referred to the European Court of Justice (ECJ).

ACTA treaty contrary to public interest

A HANDFUL of people gathered yesterday to protest against the Anti-Counterfeiting Trade Agreement (ACTA), currently referred to the European Court of Justice for scrutiny.

ACTA is an international trade agreement to help countries be more effective against large-scale intellectual property rights violations.

It is designed to make it easier for countries to exchange information on infringement of any intellectual property and stop the marketing and use of devices or products circumventing technology.

This is anathema for people who rely on the internet to get high-quality information fast, by using websites such as Wikileaks, which actually made ACTA public by leaking a discussion paper in 2008.

Pre-release with a new information about ACTA in the EU

Today the EU Commission decided to ask the European Court of Justice
about the consititutional compatibility of the ACTA. The decision is
made after big protests against the ratification process in many member
states.

A judicial trial is of course necessary. But this decision is still
extremely strange, both in terms of time and shape. A court statement is
limited to only take into account the so called primary law of the
union, the treaties. ACTA is about much more than this, says the Pirate
Party MEP Amelia Andersdotter.

"Yo-ho-ho! And a bottle of rum! "I do not know about you, but when I hear the word pirates I always think of men with shabby clothes, teeth rotten from chewing tobacco, often with a missing leg or arm, with the typical pirate hat and a bottle of their favorite rum in hand, looking for the treasure of Captain X on a remote island. In recent years we have started talking again about pirates, but they do not even remotely resemble the characters from my favourite children's books.

Today's pirates are among us, they are interested in the things that affect our contemporary daily lives and have ideas on how to change them. The first pirate party in the world was established in Sweden six years ago. Since then pirate parties have been established in 56 countries worldwide, and 21 of them are now officially recognized. In Europe they have already elected two Members of the European Parliament, 15 Members of the local Parliaments and 194 municipal councilors. A few days ago in the Greek media the news appeared that the establishment of a Pirate Party is also expected in the country. GRReporter contacted Anestis Samurkasidis, owner of an e-commerce company, who explained what drove the pirate flag to the warm Mediterranean.

Wrapping up the last of the United Kingdom's notorious copyright infringement "pay up" letter cases, a UK patent and copyright judge has had a major revelation. Just because some lawyer cites an Internet Protocol (IP) address where illegal file sharing may have taken place, that doesn't mean that the subscriber living there necessarily did the dirty deed. Or is responsible for others who may have done it.

"What if the defendant authorises another to use their Internet connection in general and, unknown to them, the authorised user uses P2P software and infringes copyright?" asked His Honour Judge Birss QC last Tuesday.
